An offer of work is not entry permission
Foreign nationals accepting employment in American Samoa must complete the employment-based immigration process before entering. Legal Affairs identifies P-45 and requires approval before entry. This current-rule guide concerns overseas hires, whose proposed start date needs to accommodate a government decision.
The distinction is especially important because the American Samoa Visitors Bureau lists some business activities that visitors can undertake, including meeting associates, negotiating contracts and attending conferences. It separately prohibits employment under the Entry Permit Waiver Program. A meeting about a possible job and starting that job are different activities. Applicants should describe the proposed duties to Immigration, rather than select a short visitor route because an employer wants an early arrival.
The sponsor must match the employment arrangement
The government Office of the Secretary’s 2024 Administrative Code includes rules on employing foreign nationals. The employment-entry provisions say a worker must obtain permission for the specific employment and cannot work for an employer other than the sponsoring employer. They identify a United States national or an established business in American Samoa as a possible sponsoring employer and make the worker and sponsor subject to the immigration requirements.
The code also requires the sponsoring employer to satisfy the Immigration Board about the inability to recruit a qualified American Samoan and reasonable steps toward eventual replacement by an American Samoan. This is an employer-side requirement, not something the foreign worker resolves merely by producing a qualification. A company considering a hire should establish what recruitment and training evidence Immigration expects for the proposed role. The published provisions do not guarantee that a vacancy will be approved for overseas recruitment or that permission transfers automatically to a new company.
Separate the application charge from the later bond
Legal Affairs lists USD 75 for an employment application and USD 30 for an identification card, with a country-dependent bond after approval. The USD 105 combined charges exclude the bond. Confirm the applicable category and who pays each item.
The page names Immigration’s office in Utulei’s Executive Office Building but its renovation notice gives DYWA Pago Pago as the temporary location. Call the published main number, (684) 633-4163, to ask where P-45 is currently issued and received. Neither address was directly confirmed.
An employer checklist can add another clearance stage
American Samoa Community College’s personnel manual provides a concrete institutional example for its own off-island contract-specialist recruitment. It requires the selected applicant and accompanying dependants to provide sufficient health evidence and a security-background check. Where applicable, Human Resources requires the immigration document permitting entry and employment before work. Final selection is contingent on physical-examination and immigration-permit approval when required.
These are ASCC employment-clearance instructions, not proof that every employer uses the same medical form or that the college can decide an immigration petition. An illustrative overseas lecturer offered an ASCC contract should therefore check both Human Resources clearance and government permission before treating the start date as settled. Another employer should provide its own written conditions. Dependants should not assume that inclusion in an employer’s relocation plan gives them independent work rights or settles their immigration category.
Resolve missing details before arranging arrival
The P-45 summary does not establish a full document checklist or processing guarantee. Ask Immigration what evidence the worker, employer and dependants must supply, what approval to carry, and how a change of duties or sponsor affects permission. The employer should coordinate those questions with its own recruitment and clearance requirements, keeping government permission separate from its internal hiring decision.
The practical deadline established by Legal Affairs is approval before entry, rather than a fixed number of days after accepting an offer. The visitor guidance’s advance-application timing concerns visitors and should not be adopted as an employment-processing promise. Keep travel arrangements consistent with the eventual permission, and obtain Immigration’s direction if the employer, duties or family circumstances change. None of the reviewed resources establishes automatic lawful work or continued stay while an unapproved employment petition is pending.
