Match a renewal to the existing employment terms

Anguilla's Work Permit Regulations 2023 distinguish renewing an existing arrangement from varying it for a new employer. Under regulation 12, renewal applies where employment terms and conditions generally remain as originally submitted. General permits use Form 1 in Schedule 3; self-employed permits use Form 2. This is guidance on the existing framework, not an announcement of a new November application category.

The regulations specify a $300 renewal processing fee and say a granted Notice of Renewal is valid for three months. That notice period should not be confused with a promise that every renewed job is authorised for only three months. A proposed employer change follows regulation 13 instead: the prospective employer requests variation and provides the existing employer's consent, the employee's consent, changes in employment terms and proof of the variation fee, also $300. Describe the actual change to Labour rather than presenting a new job as an unchanged renewal.

The employer must assemble recruitment and compliance evidence

The government's Labour service page says vacancies must be advertised before an application is submitted. Its checklist asks for the advertisement, completed application, birth certificate and passport, a police record covering ten years, certified academic or professional qualifications, a recent medical report and four identical passport photographs. These records establish different parts of the case; a passport alone does not provide the recruitment or qualification evidence requested.

The employer must also supply a business licence, tax clearance and a Social Security certificate showing registration or up-to-date contributions. The service warns that incomplete applications are returned and delayed. Its older fee wording quotes an additional EC$100 processing charge, which differs from the 2023 regulations' specific renewal provision. Confirm the current category and assessment with Labour before payment; neither figure should be described as the complete cost of every permit, since the service also says charges depend on the position and qualifications.

Resolve Social Security records before requesting clearance

The Anguilla Social Security Board's employer-registration guidance requires a completed registration form and an original business licence. It says the duty covers employers with even one part-time employee and warns against employing an unregistered worker. A small business cannot therefore assume that its size removes the registration issue identified in the work-permit checklist.

The Board's employer-contributions page gives the rates effective from 1 January 2026: an employee deduction of 5.75%, matched by the employer, subject to the statutory contribution ceiling. It requires a Contribution Certificate, Form CR-1, with each payment and accurate employee names, birth dates and Social Security numbers. Use that page and the employer account to check credited payments before seeking compliance evidence. It also directs employers to notify the Board promptly in writing when employment ends, a relevant administrative step when a permitted worker changes jobs.

Labour approval and immigration endorsement remain distinct

The government's Immigration & Labour service page says a work-permit stamp endorsement requires the work permit, identified there as Form C, a photograph and the passport. A worker should arrange that immigration step after obtaining the relevant Labour document rather than assuming that an employer's application receipt is already the passport endorsement. The same page separately describes visitor extensions and publishes Immigration's main-office telephone number, +1 264 497 3994, for the appropriate enquiry.

Permanent residence also should not be treated as a universal work-permit exemption. In its 9 April 2026 minutes, the Executive Council specifically noted that the permanent-residence grants under consideration did not exempt recipients from the Labour Relations Act or Work Permit Regulations. That is evidence concerning those decisions, not a new general immigration amnesty. Applicants with a claimed exemption should establish its actual basis with Labour. The reviewed resources do not provide one universal advance filing deadline or a guaranteed renewal turnaround; resolve the renewal or variation and any expiring immigration permission before relying on continued employment.
