Establish the residence route and supporting evidence
Antigua and Barbuda’s Immigration Department distinguishes a resident permit from a visitor’s entry permission or a work permit. This current guide explains existing application and renewal requirements, rather than announcing a new residence programme. The status actually issued matters when planning continued employment or a family member’s stay.
The Residency service page identifies ordinary lawful residence of at least four years, or marriage to an Antiguan citizen for at least one year, as grounds for applying, subject to its additional conditions. It requests police-character evidence from Antigua and Barbuda and relevant previous places of residence, a directed medical certificate, statutory-board evidence of tax contributions, passport identity-page evidence and birth or marriage records. Further documents may be required. Use that service page to establish the application evidence; accumulating years of employment or having a marriage certificate should not be treated as approval before the Chief Immigration Officer has decided the case.
Renewal and a change of grounds need attention before expiry
The department’s Residency Permit FAQs instruct holders to apply for renewal three months before the existing permit expires. They describe grants ranging from one to three years, rather than a single fixed period for every resident. The document’s actual expiry should therefore be checked instead of calculating a renewal date from a general description of the category. Submitting a renewal should not be assumed to guarantee approval.
The same FAQs warn that a student’s status remains temporary while study remains the basis of residence, and expressly say students may not work under that status. Where circumstances change, such as marriage to a citizen, the person may need an application on new grounds rather than a routine extension of the old category. The page also warns that residence may be revoked when its original grounds cease or after a continuous absence of six months or more. Before a long trip, clarify the effect on the particular permission; a card whose printed expiry remains in the future may not answer every continuity question.
Work permission does not automatically settle the family’s position
The Extensions FAQs explain that a work permit is issued by the Labour Department, while Immigration determines the corresponding extension of stay under separate legislation. The worker still needs the relevant passport endorsement. The department does not regard a work permit alone as resident status or an automatic right of abode. It also says family members cannot ordinarily settle merely because the principal holds a work permit; applicable exceptions need the Chief Immigration Officer’s approval.
Marriage to a citizen likewise does not automatically remove a visitor’s need for an extension. The FAQs identify possible exceptions for OECS Protocol-State citizens, CARICOM skilled-certificate holders’ spouses and other special categories, which need to be established in the individual case. For illustration, a spouse already visiting should identify their current authorized date and the particular exemption or application being relied on. They should not wait for a future residence decision on the assumption that the marriage or principal worker’s labour approval has already extended their stay.
Confirm the extension charge and the evidence for the actual application
The dedicated Extension Fees table lists an XCD50 non-refundable processing charge and, for an extension up to three months, XCD75 for CARICOM nationals or XCD150 for others. However, the separate Extensions service page mentions application charges of 150 or 300 dollars. These official pages are inconsistent and should not be combined into a confidently stated total or treated as a newly announced fee change. Obtain the amount applicable to the actual category from Immigration before paying.
The Extensions service page identifies practical evidence including the reason for additional time, a valid return ticket or security deposit, sufficient funds, legitimate accommodation, relevant work or student permission and sponsorship forms where applicable. It says processing payment does not establish that an extension will be granted. The Residency Permit Fees page does not provide a usable published tariff in the material reviewed, so no universal resident-renewal charge is confirmed here. The immediate task is to distinguish a resident renewal from a visitor extension, identify any separate family application and resolve the payable amount while the present permission is still valid.
