The July ruling challenged the transfer of decision-making powers
Argentina’s citizenship applicants need to distinguish a published government application process from the judicial dispute over who should decide naturalisation cases. In a report dated 2 July 2026, the federal prosecution service said the National Electoral Chamber confirmed electoral-court jurisdiction and declared emergency decree 366/2025 invalid in the case before it. This November review follows that existing dispute; it does not announce a new ruling or establish that every pending application has received the same treatment.
The reported case concerned a Chinese applicant whose request had been rejected at first instance because of irregular immigration status. The prosecution service says the chamber overturned that decision and upheld its jurisdiction, questioning the executive’s use of emergency powers to alter citizenship arrangements. The official report helps readers understand the constitutional issue, but does not itself confirm an individual applicant’s entitlement to nationality, the final position in every subsequent case or a universal instruction to abandon an administrative filing.
An earlier prosecutor’s opinion took a different position
The same prosecution service published a separate report on 20 March 2026 about a Russian applicant’s challenge to Migraciones handling citizenship requests. In that matter, prosecutor Miguel Ángel Gilligan considered the transfer constitutional and recommended rejecting the challenge. He reasoned that the administrative route did not remove the possibility of judicial review following refusal. That was a prosecutor’s opinion in a particular proceeding, not the July chamber ruling and not proof that the applicant had been granted citizenship.
The two reports illustrate why the date, institution and type of legal document matter. A recommendation by a prosecutor and a decision by an appellate court have different procedural roles. Someone with an existing case should retain the actual court orders and filing history and establish which authority currently has conduct of that case. Reading a headline about another applicant is insufficient to determine whether to lodge an appeal, change route or discontinue an existing proceeding.
The decree text explains the administrative model and older cases
Decree 366/2025 was published on 29 May 2025. Its citizenship provisions assigned naturalisation decisions to Migraciones and described continuous lawful residence during the preceding two years, with no departure during that period. These are the decree’s published terms, whose operation must be read against the subsequent judicial dispute. They should not be presented without qualification as a settled answer for every applicant who has taken a short trip abroad.
The decree also contains a transitional provision for citizenship proceedings begun before it entered into force: those cases continue before the court already handling them under the grounds applicable at commencement. This makes the filing date materially important. Keep evidence of when a case actually began, including its assigned number and notifications, rather than relying on when documents were first collected. The decree’s investment provisions do not establish an automatic citizenship entitlement from purchasing property, and the sources reviewed do not verify a universally available investment amount or guaranteed decision timetable.
The online portal remains a practical resource, with unresolved limits
Migraciones’ RaDEx citizenship page still describes a two-stage online process. It says applicants must be inside Argentina, that the system checks granted residence and time in the country, and that the declared email address is used for additional-document requests and an in-person appointment. Documents must be uploaded as scans or photographs. The portal says the process is not completed until all required steps have been met and commencement is confirmed with an assigned case number.
Use that official page to understand the administrative process, while checking the competent authority and applicable instructions for the particular case before starting a competing filing. The page says an intermediary is unnecessary. It does not display a complete fee quotation in the material reviewed, so verify any charge through the official process rather than accept an agent’s claimed mandatory package. Applicants facing a refusal or court deadline should act on their actual notification; these sources do not establish one new nationwide appeal deadline. The unresolved issue is how the competing legal and administrative positions affect each proceeding, not whether an online account alone grants citizenship.
