The new location rules apply to applications from 12 November
People planning an Australian Training visa application should review their location before lodging. Regulations registered on 30 October 2026 commence on 12 November and apply to applications made from that date. They generally require applicants to be outside Australia both when applying and when the visa is granted. An applicant who only leaves for submission should therefore also consider where they will be when the application is decided.
The legislation allows the Minister to specify exempt classes through a separate legislative instrument. The regulations themselves do not identify a universally exempt nationality, training occupation or family category. No applicable exemption instrument was verified for this report. Earlier applications remain subject to the previous rules; the new commencement date should not be mistaken for a deadline by which every pending application must be decided.
Sponsorship and nomination must already be approved
The Home Affairs subclass 407 guidance says the sponsor must be approved as a temporary activities sponsor. Unless the sponsor is an Australian Commonwealth Government agency, the training nomination must also be approved before the visa application is made. The Commonwealth agency exception removes the nomination requirement, not the need for approved sponsorship. An employer merely agreeing to provide a placement is therefore insufficient.
Home Affairs warns that an onshore application from 12 November will be invalid even if ImmiAccount accepts its submission, and an invalidity decision cannot receive merits review. Applicants should not infer lawful status from an electronic receipt. Its guidance describes this visa as temporary, normally for up to two years, and not for ongoing employment or filling workforce shortages. Confirm the training file is approved and the location rule is satisfied before paying. A current numerical visa charge was not verified here; check the live application charge before submission.
Match the nomination to a genuine training category
The separate occupational training types page distinguishes three purposes. Training for registration concerns workplace training needed for compulsory occupational registration, membership or licensing in Australia or the person’s home country. Skills-improvement training must be structured, tailored to the nominee and linked to an eligible occupation. It requires recent suitable employment or study experience equivalent to at least 12 full-time months in the 24 months before nomination.
Capacity-building training has further categories. Students enrolled at an overseas institution may undertake up to six months of structured practical training, research or observation required for their qualification. Government-supported training must meet the specified Australian or overseas government support arrangements. Professional development involves face-to-face classroom-style programs for overseas employers’ managerial or professional employees. These distinctions help a sponsor explain the training purpose; calling an ordinary vacancy a training opportunity does not establish that it meets a nomination category.
Prepare health cover as part of the relocation budget
Home Affairs’ separate insurance guidance explains that most visitors cannot rely on Medicare and remain responsible for healthcare costs. Condition 8501, where imposed, requires adequate insurance arrangements while the holder is in Australia. Check the conditions of the visa and the policy offered for the trainee and any accompanying family, including the evidence needed for the application.
Private cover may still leave gap expenses payable by the patient. The guidance recommends obtaining estimates of treatment costs, insurance benefits and the balance payable before receiving care. Compare waiting periods and exclusions rather than considering only the premium. An insurance purchase does not resolve the offshore application requirement or establish that the training nomination has been approved.
Use workplace resources for pay questions
Trainees should also distinguish immigration permission from employment protections. The Fair Work Ombudsman says migrant workers have the same workplace rights as other employees, including pay, leave and protection from discrimination. These protections continue even where migration status is problematic, although separate immigration consequences can still arise. An employer cannot use an immigration concern as a reason to withhold entitlements for work already performed.
Use the Ombudsman’s migrant-worker resource for workplace questions and Home Affairs for visa eligibility and conditions. Fair Work provides free assistance and says contacting it for help does not cancel a visa. Readers needing language assistance can call the Translating and Interpreting Service on 131 450 and ask to connect to Fair Work on 13 13 94. This assistance does not grant a visa or waive an application-location rule.
