The application date determines the certificate framework

Non-Caymanian spouses and civil partners seeking residence and employment rights through a Caymanian partner should identify when their application was submitted. WORC’s reform FAQ says applications pending from before the new legislation commenced on 1 May 2026 are considered under the 2022 Act. If approved, those certificates are indefinite. Under the newer framework, certificates may instead be issued for up to fifteen years.

The FAQ says a holder may apply for indefinite renewal after at least fourteen years; this is an application opportunity, not automatic conversion. Existing certificate holders are not exempt from the new annual declaration requirement merely because their permission is indefinite. For valid certificates issued before commencement, the FAQ places the declaration on the issue-date anniversary each year, with a CI$100 fee. Check the certificate and filing history before selecting a form.

Use the May 2026 spouse application and its relationship evidence

The R38 form is specifically for a spouse or civil partner of a Caymanian. Its checklist asks for a joint cover letter explaining how the couple met, employment letters for both partners or an explanation of unemployment, and an affidavit signed before a justice of the peace or notary. It also calls for certified relationship and identity evidence, proof the partner is Caymanian, the applicant’s birth certificate, police clearance and a medical-declaration cover letter.

The form publishes a CI$300 submission fee. It requests three written references with referees’ identity evidence, sealed and signed across the envelope seals, plus full-face and profile photographs. Previous marriages or partnerships require relevant dissolution or death evidence. Use the general spouse checklist rather than the separate continuation checklist relating to a Caymanian child. Its indefinite-renewal section does not bypass the applicable first-certificate period. WORC reserves the right to request additional material.

The declaration is an ongoing disclosure rather than a fresh grant

DEC38, the June 2026 annual-declaration form, is limited to people who continue to hold residence and employment rights as a Caymanian’s spouse or civil partner. It requires details of both partners and confirmation that the Caymanian partner continues to hold that status. Changes in the relationship require a signed affidavit explaining the circumstances and their date, including breakdown, separation, divorce or dissolution where relevant.

The form asks about employment, income, dependants and changes in their number, alongside any relevant financial and positive contribution to a Caymanian child’s life. It directs a separate variation application to add or remove dependants. Reporting a child on the declaration therefore should not be treated as obtaining permission for that child. Send the completed declaration with payment proof using the submission instruction printed on the official form, and retain a copy. The form’s instruction is a document-filing route; it does not establish a guaranteed receipt or decision time.

Reconcile the police certificate’s validity before ordering it

The Police Service FAQ says local clearances are valid for three months from generation. That differs from R38’s checklist wording accepting an applicant’s clearance up to six months old. Those statements address different institutions, but neither page explains how WORC treats a locally issued certificate between three and six months old. Ask WORC which age limit it applies before relying on the longer period. A recently obtained certificate avoids that particular timing conflict, without guaranteeing acceptance of the overall file.

The Police FAQ gives a ten-business-day turnaround and directs online application and payment. Its detailed answer says delivery may be electronic or by registered domestic mail and that in-person collection is unavailable, although introductory text still mentions collection. Use the current delivery choice shown during application and resolve any uncertainty with the Criminal Records Office. No police-clearance charge is quoted here because the examined FAQ does not establish an amount. Coordinate this certificate’s issue date with the relationship documents and medical evidence before submitting the spouse application.
