Chile harvest employers must distinguish Mercosur residence from seasonal permits

The harvest campaign explains existing permission routes

Chile’s agricultural employers preparing for the 2026–2027 harvest season should check the worker’s actual immigration permission before treating a signed employment contract as sufficient. In an October 7 report, the National Migration Service described employer briefings in Chillán and Curicó covering lawful recruitment, residence options and inspection procedures. The campaign highlighted Mercosur-linked residence alongside other alternatives; it did not announce that every foreign harvest worker receives automatic authorisation.

This current guide follows those briefings and distinguishes two potentially relevant routes. A nationality-based temporary residence permission and the dedicated seasonal-worker subcategory have different conditions. A farm may need labour for the same harvest dates, but two prospective employees can require different applications because their nationality, existing status or intended annual stay differs. Use SERMIG’s October report for the campaign’s context and the substantive permit pages to identify which rules govern the individual application.

Seasonal permission limits each calendar year’s stay

SERMIG’s seasonal-worker page describes temporary residence for specific seasonal work during limited, single or recurring periods. The permission can be granted for up to five years, with a possible further two-year extension, but the person’s stay cannot exceed six months in each calendar year. A multi-year document should therefore not be read as permission for uninterrupted year-round residence or an unrestricted annual work period.

The application is made from outside Chile. The route normally requires a contract with an employer established for tax purposes and domiciled or operating through a Chilean branch, with services connected to its principal activity. Formal offers are also contemplated for nationals covered by relevant bilateral seasonal-worker agreements. Following favourable assessment, the described residence-in-process certificate permits entry; after entering, the worker has 45 days to present the notarised contract copy and electronic contract-registration evidence. Use the seasonal page to plan that post-entry task before work arrangements are finalised.

The online application needs employer and worker evidence

SERMIG’s step-by-step seasonal guide directs applicants to the overseas Temporary Residence procedure, then the economic-reasons and seasonal-worker options. It asks for legible, current and appropriately legalised identity and criminal-record evidence. Its employer-related upload steps identify the employment contract, the tax-service commencement-of-activities certificate and proof of the signing person’s legal representation. The employer should prepare its part while the worker assembles personal records.

The guide also explains the payment and submission sequence. Applicable rights depend on the requested benefit, with possible exemptions under agreements and for applicants under 18; it does not establish one universal harvest-worker fee. Confirm the charge presented for the correct nationality and benefit. After payment, where applicable, complete the final submission rather than assuming payment alone lodged the file. Use an email account that remains accessible because receipt and later analysis communications are sent there.

Mercosur-linked residence has a specific nationality list

SERMIG’s reciprocity page lists nationals of Argentina, Bolivia, Brazil, Paraguay and Uruguay for this Chilean temporary residence subcategory. Broader references to Mercosur should not be substituted for that explicit eligibility list. The permission can last up to two years and allows lawful remunerated activities, subject to labour-law restrictions concerning minors. That differs materially from the seasonal subcategory’s six-month annual stay ceiling.

This application is also made from abroad. The checklist requires a valid passport, except that Bolivians may present a valid national identity document under the bilateral arrangement, together with the applicable criminal-record evidence and a recent photograph. The page confirms removal of the application tariff for Bolivian nationals and directs other nationalities to the fee schedule. Use this resource to compare the applicant’s nationality and documents, not to assume that an invitation from an agricultural employer makes an otherwise ineligible nationality eligible.

Match the staffing plan to permission rather than the job label

For an illustrative comparison, an employer assessing a Bolivian applicant and an applicant outside the reciprocity list should first establish the residence route available to each. Identical harvest duties do not resolve that question. The employer then needs the correct contract and organisational evidence, while the worker must complete the appropriate overseas process. Neither attendance at an October information session nor a recruitment intermediary’s assurance replaces the required permission.

No universal harvest application closing date or guaranteed processing period was verified in these resources. The decisive dates include the intended entry, the seasonal route’s annual stay restriction and its 45-day contract-evidence requirement where applicable. Employers should allow time for complete applications and avoid promising a start date based solely on a projected decision. The published campaign’s stated objective is formal recruitment; using the right route from the outset is the practical way to support it.
