Identify the dependent permission and request a safe contact route
People in Ireland whose immigration permission depends on an abusive spouse or partner can ask ISD for independent permission. The current web guidance says an abusive relationship need not be maintained to preserve entitlement to remain. Applications go in writing to the Domestic Residence and Permissions Division or through the Customer Service Portal, using Domestic Abuse as the subject. A solicitor or representative can correspond for the applicant.
The webpage excludes unlawfully resident applicants. The December 2023 guidelines mention someone who recently held dependent permission. If permission has expired, ask ISD how that wording applies to the actual dates. Neither text establishes an automatic grace period.
Provide the evidence available and explain missing identity records
The linked ISD guidelines request copies of the passport and IRP where possible, expressly recognising that these may be unavailable. Explain missing documents rather than allowing an incomplete identity bundle to go unexplained. Supporting evidence can include court orders, medical records, Garda incident reports, letters from a State body or a domestic-abuse organisation, and other relevant material. The list is illustrative; every listed document is not required.
Include details of minor children living with the applicant, their nationality, birth dates and identity records if available. The guidelines allow correspondence at an address agreed with the applicant and through a nominated support organisation. Request that safe address explicitly in the covering letter. Use the live webpage’s portal rather than relying on an older email address.
Recognise what an existing court order actually protects
The Courts Service explains that a Protection Order and a Barring Order do different things. A Protection Order can direct someone to stop violence or threats, but does not order a respondent already living in the home to leave. Barring orders concern leaving and staying away from the home. The name and current terms of an order therefore matter when describing the family situation to ISD.
The Courts Service distinguishes immediate temporary orders from longer-term protection and explains that a Protection Order is sought alongside a Safety Order or Barring Order application. Supply the actual order and its terms if one exists, rather than describing an application for an order as an order already granted. These are court protections with their own eligibility requirements; they do not themselves grant immigration permission or substitute for ISD’s separate decision.
Keep registration charges separate from the permission application
ISD’s registration FAQ lists a standard €300 registration fee, subject to the applicable category, and says payment for an online application is prompted by credit or debit card when required. There is no fee for the independent-permission application, but the detailed guidelines say the normal registration fee may apply according to individual circumstances. A free independent-permission application should therefore not be presented as a promise that all subsequent registration costs are waived.
The FAQ says stamp changes and renewals use online applications unless a registration officer specifically directs an in-person attendance. Follow the decision letter’s instructions for the individual case and ask the registration service about any disputed fee category before selecting an exemption. The FAQ warns that an incorrect fee-waived application can be refused for non-payment. Keep the permission decision and registration/payment record together; a receipt alone does not describe the conditions granted.
Read the independent conditions and preserve the expiry date
The live domestic-abuse guidance says an approved applicant receives Stamp 4 independent of the sponsor. ISD’s separate stamp guide explains what that condition means: employment does not require an Employment Permit, and a person may establish and operate a business. A regulated profession still has the conditions imposed by its professional body. Access to public funds or services remains subject to the rules of the relevant agency.
Stamp 4 is permission for a specified period, with renewal required before it expires. Read the actual decision and card dates rather than treating independence from a sponsor as permanent residence. An acknowledgement, request for evidence or pending application is not the same thing as that approval. The stamp guide explains that the IRP records the permission conditions and is evidence of legal residence; preserve the card and check that its recorded category matches the decision received.
