El Salvador

El Salvador’s spouse residence route requires one uninterrupted year of temporary residence

Foreign spouses and partners of Salvadorans should check the temporary-residence requirement before applying for definitive residence. Marriage registration and subsequent residence endorsement are separate steps.

Marriage alone does not complete the residence requirement

Article 152 of El Salvador’s published Special Migration and Aliens Law provides definitive residence for a foreign spouse or cohabiting partner of a Salvadoran after one uninterrupted year of temporary residence. This current guide describes that documented route, not a new November concession or automatic residence on marriage. Check the foreign partner’s residence history, rather than using the wedding date alone.

The law permits definitive residents to undertake lawful paid or profitable activities, either independently or as employees. That right follows the qualifying immigration status and should not be assumed from the relationship alone. Foreign public documents require authentication or apostille, as applicable, and appropriate Spanish translation under Article 162. Use the official law and the linked F34 application instructions to identify the category, then obtain case-specific confirmation where residence continuity or a document’s form is uncertain.

Assemble the F34 relationship and financial evidence

DGME’s official definitive-residence page links the F34 instructions for spouses and cohabitants. The form requires the valid passport and copies of used pages, evidence of economic maintenance through a notarised declaration, and the applicable relationship evidence. For marriage, it asks for a certificate registered in El Salvador; a marriage celebrated abroad must be legally registered there. For a non-marital union, it lists a sworn declaration detailing the relationship’s duration. Check which supporting identity records apply to the individual case.

The instructions call for a current Salvadoran police clearance where the applicant has spent more than three months in the country or entered more than twice in the preceding year. They quote a maximum 45 working days for a complete application and non-refundable charges of US$135 for Central Americans and US$345 for other nationalities. Obtain the official payment instruction from Extranjería and confirm the current charge before paying; submission does not itself establish approval.

Register an overseas marriage through the correct channel

The National Registry’s published Family Status Registration Law addresses civil events acquired abroad separately from immigration permission. Article 91 provides for Salvadoran consular registration using the Registry’s electronic systems. Article 92 identifies RNPN as competent for relevant registrations and provides a route for overseas Salvadoran marriages that were not registered at the corresponding consulate. Couples should ask RNPN or the Salvadoran consulate how their particular foreign marriage will be entered in the domestic record.

The law describes a maximum 45-working-day period from accreditation of an unregistered event through the respective document, followed by a US$25 penalty for late registration. That is not a blanket period running automatically from every overseas wedding. It also allows an interested person to present properly authenticated or apostilled foreign evidence, with competent Spanish translation where necessary. Resolve the civil registration before relying on it in the residence file, and keep the civil-record deadline distinct from the immigration decision period.

Definitive residence still needs timely endorsement

DGME’s F37 instructions address endorsement of definitive residence for all nationalities. They direct applicants to file within the 30 calendar days before expiry and require the signed application and original passport for checking. If the passport has changed, the instructions require a certified copy of the current document and its used pages. A grant of definitive status should therefore be followed by a diary entry for the document’s endorsement, rather than an assumption that no further immigration administration is needed.

The linked schedule offers endorsement periods of one to four years. Published charges range from US$30 to US$95 for Central Americans and US$65 to US$205 for other nationals, depending on the period requested. The instructions describe one working day for a complete request, which should not be mistaken for F34’s initial decision period. Confirm the applicable payment and attendance arrangements with Extranjería before expiry. Use F34 for the relationship-based application and F37 for the later endorsement; they serve different stages.
