Equatorial Guinea applicants have one month to seek a Spanish family visa after approval
Where a Spanish relative applies from Spain while the foreign family member is abroad, the approved applicant has one month from notification to request the corresponding visa. Other family situations use different procedures.

Check which family application sequence applies
Spain’s Migration Ministry guidance describes a specific sequence for an Equatorial Guinea resident joining a Spanish relative: where the sponsor is in Spain and the foreign relative abroad, the sponsor first requests residence authorisation. After approval, the family member has one month from notification to apply for the corresponding visa at the competent Spanish consular office.
This explains the current route, not a new November rule. Where both relatives are abroad, the ministry describes a different consular sequence. Keep the approval notice and notification date and contact the competent consulate immediately; the post-approval deadline does not apply indiscriminately to every family case.
Confirm that the relationship falls within the Spanish-relative route
The consolidated immigration regulation covers qualifying foreign family members of Spaniards who are not themselves EU, EEA or Swiss nationals. It includes spouses, with conditions concerning age, a valid marriage and absence of fraud, alongside other specified family relationships. A marriage certificate or family connection alone does not prove that every category’s conditions have been met. Use the actual relationship provision instead of a generic family-reunion checklist.
The regulation states that the Article 97 procedures receive preferential handling and are free. That does not establish that every associated civil document, translation, legalisation or identity-card service costs nothing. Obtain an itemised explanation of any requested ancillary charge. The regulation also requires the arriving foreign relative to seek the identity card within one month of entry in the relevant overseas-application cases. Visa filing and the later card application have separate triggers.
Distinguish this status from older EU-family arrangements
The Migration Secretariat’s official 2025 instructions distinguish the national Spanish-relative status from the rules for family members who are themselves EU, EEA or Swiss nationals. They also address third-country relatives holding documents from the earlier EU-family system. Applicants should tell the authorities about any existing Spanish or European residence document rather than assume that all family documents must be replaced through a new overseas application.
For an Equatoguinean citizen, the relevant question is the combination of nationality, relationship, current residence and any existing permission. A foreign passport held alongside Equatoguinean nationality can change which legal framework needs checking. Use the instructions to identify that question, then obtain a determination from the competent office. Do not surrender an existing residence document or pay for a replacement procedure solely because a private adviser uses a different family-visa label.
Verify local submission and civil-document arrangements
The Spanish embassy in Malabo’s public consular notice directs national-visa appointment enquiries to [email protected] and separately describes document legalisation. It is an older notice containing legacy visa categories, so applicants should use the official contact to confirm the current Spanish-relative submission procedure, rather than assume every listed category or timetable remains current.
Ask which consular office is competent for the actual residence, how to present the approval notice, and which original relationship records and legalisation steps are needed. State the notification date when requesting instructions so the one-month visa deadline is visible. The embassy notice’s document services are separate from the free residence procedure. Confirm any current legalisation charge and representation requirements directly before attending or sending original records.
Prepare the identity-card stage after arrival
Spain’s National Police identity-card resource links form EX17, the relevant 790-012 payment document and its fee schedule. It identifies the card as evidence of lawful immigration status and directs applicants to the competent immigration or police office. Use those official links to identify the applicable card service rather than select an unrelated fee category.
The police page also explains that the card follows entry or a favourable residence decision. Arrange the appropriate personal appointment and supporting file in time for the applicable deadline. Retain the entry evidence and residence decision together, because the overseas visa application and the domestic card appointment establish different parts of the record.
