Eswatini employers face seven-day notice after permit-linked employment ends
Current guidance: the immigration regulations set an employer reporting deadline, while employee and dependant applications require different evidence.

The seven-day obligation belongs to the employer
Eswatini employers should distinguish an employee’s last working day from the expiry printed on an immigration document. The Immigration Regulations published by the government require the named employer to report cessation of employment in writing to the Chief Immigration Officer within seven days where the worker holds an entry permit in classes A to C. This is a current compliance guide to an existing provision, not a newly announced November restriction.
The reporting rule is specifically tied to those permit classes. It should not be extended without verification to every dependant, student or visitor. For a covered employee who resigns or whose contract ends, the employer should establish the actual cessation date and arrange the written notice immediately. An internal payroll update alone does not establish that Immigration received the required report.
A future employer needs its own immigration assessment
The regulations also provide for the Chief Immigration Officer to vary permit conditions and, with the Minister’s written consent, cancel a permit. An unexpired document therefore should not be treated as freely transferable between employers. A prospective employer should seek confirmation of the appropriate permission before scheduling the worker to begin the new role.
The Ministry of Home Affairs Immigration page explains that its permits section handles work, student, dependant and visitor permissions, with applications assessed on their merits by a committee. That is the resource for identifying the responsible administrative section. It does not promise approval merely because an applicant has a job offer, nor does it establish an automatic right to work while an application is pending.
As an illustrative sequence, an employee leaving one company while discussing another offer needs the original employer’s cessation report and a decision on the new employment permission. Neither step substitutes for the other. The precise immigration outcome depends on the worker’s permit class and conditions; a signed new contract is evidence for the assessment, not the assessment itself.
Use the employee checklist rather than the business-owner list
The government-operated eVisa portal’s Visa Requirement Documents page separates Employee – Part I from Business Person – Part II. For employees it lists a completed application, photograph, employer covering letter, proof that the post was advertised, original police clearance, medical certificate and certified passport copy. It also uses the label Qualification Agreement, whose exact documentary meaning should be clarified with the permits section before submission.
This distinction matters where a company recruits a salaried specialist rather than admitting a shareholder to operate a business. The business-person list instead includes corporate and premises evidence such as incorporation documents, memorandum, lease and Forms I and C. Applicants should not substitute company ownership papers for the employee recruitment evidence required for their actual route.
The same portal lists a separate dependant file, including the guardian’s residential status, covering letter, relationship evidence, medical and police information and passport copy. It does not establish that every dependent may take employment. Families should ask which evidence applies to the individual’s age and relationship and whether separate work permission is necessary before accepting a position.
Confirm fees, entry permission and the individual expiry date
The published regulations contain historical fee schedules, and older government service documents remain available online. A current payable employee-permit total could not be established reliably from the accessible fee material reviewed. Obtain a category-specific official quotation before payment, distinguishing the application or issuance charge, renewal and any other required item. An old statutory table should not be represented as a verified November 2026 invoice.
The eVisa portal’s application guidelines say that people intending to work need temporary residence permission rather than relying on an entry visa. Nationality-based entry exemptions must therefore be checked separately from employment eligibility. An exemption from obtaining a tourist visa does not by itself answer whether a particular employer may engage the traveller.
The immediate fixed deadline identified here is the covered employer’s seven-day cessation notice. The worker must also establish the effect on their own lawful stay, any existing permission and accompanying family members. Use the published regulations for the legal reporting provision, the portal for the document checklist and Home Affairs for instructions on the individual permit. The sources do not establish a universal job-search grace period or an automatic extension following termination.
