Marriage does not give a foreign spouse immediate residence in Honduras
The published marriage-based route includes a three-year condition. Couples must also distinguish civil registration, the residence application and the later resident-card procedure.

Check the qualifying relationship and its date
Honduras’s published migration regulation says a foreign national married to a Honduran, or in a recognised de facto union with one, may acquire residence under that category after three years. Article37 also requires evidence of the relationship and the Honduran partner’s birth and identity records. This current guide, checked on 2 November, does not announce a new waiting period.
The regulation requires the authority to examine compliance with family and immigration law. Marriage alone therefore does not establish an immediate grant or permission to remain while an application is pending. Check the relationship’s recorded date and the applicant’s current immigration permission separately. Use the regulation to identify the category and ask the receiving authority about any different legal basis or exception before assuming this ordinary route fits the case.
Prepare the residence file rather than only a marriage certificate
The Interior and Justice Secretariat’s marriage or recognised-union checklist asks for an application to the responsible secretary, contact address and telephone, power of attorney, photograph, migration-movement certificate, medical evidence and passport copy. It also requests criminal-record evidence from the country of origin and last residence, together with the specified Honduran police certificate. Obtain the relevant records before submitting a file built only around the wedding document.
The checklist separately asks for the Honduran partner’s birth certificate and notarised identity-card copy. Foreign documents must be legalised and foreign-language material officially translated through the stated authorities. It lists a USD200 tariff, which should not be treated as covering every private translation or notarisation cost. An entry application authorised by a Honduran consul is listed for the overseas situation; the checklist expressly says it is unnecessary when the foreign applicant is already in Honduras. That documentary exception is not confirmation that every visitor can remain indefinitely. Use the checklist to establish the file and confirm the current payment instructions and remaining-stay requirements with the authority.
Register an overseas marriage through the civil-record process
The National Registry of Persons, RNP, publishes separate instructions for registering a Honduran marriage celebrated abroad through its General Secretariat. They call for the authenticated or apostilled marriage certificate, the prescribed handling of a foreign-language translation, current birth records for the Honduran party and copies of all documents. Confirm the applicable authentication chain for the issuing country before obtaining duplicate legalisations.
The RNP process requires a request to its Permanent Commission, made by the interested parties or a legal representative. Its instructions state that no TGR-RNP payment is due for that request. This does not mean that translation, overseas certification and every residence transaction are free. The General Secretariat issues a communication which, together with the documents, must then be presented to the municipal civil registry where the marriage will be entered. Use the RNP instructions to complete this civil-record step; it is not the decision granting the foreign spouse residence.
Complete the foreigner registration after residence approval
The government’s national procedure portal describes registration of an approved residence or special-stay permission in the National Register of Foreigners as the process leading to the resident identity card. Its sequence includes checking and digitising the evidence, recording personal details, quality control and producing the card. A residence decision and possession of the resulting card are therefore separate stages to follow through.
The registration checklist includes the application form, original and copy of the resolution certificate, original identity document or passport with copies and the paid TGR-1 receipt. The portal identifies the foreigner-management offices responsible for the process, including Tegucigalpa and regional locations. Use that dedicated registration entry to select the appropriate office and obtain the actual payment assessment; it does not publish a single amount covering every applicant or a guaranteed completion period. Keep the residence decision and receipt for follow-up, and confirm the card-collection arrangements. Neither the civil marriage registration nor an incomplete residence file should be treated as an extension of an existing immigration deadline.
