Families joining residents in Hungary should check the sponsor’s permit first

Current family-reunification rules exclude several residence categories; document translations and consular submission arrangements also need checking.

Check the sponsor’s exact residence category

Families planning to join a non-EU resident in Hungary should check the sponsor’s permit category before paying for a family application. The immigration authority’s current family-reunification factsheet excludes sponsors holding employment or guest-worker permits, seasonal employment permission, the White Card, and study or job-search permission, among other categories. Guest self-employment also requires at least a year of holding that permit. A marriage certificate does not remove these restrictions.

The same factsheet provides a specific exception for a third-country national child born in Hungary to a third-country national resident: family-reunification permission is issued even where the parent’s permit ordinarily cannot support another person’s residence. That narrow exception should not be read as opening an overseas spouse’s application. Use the official factsheet to establish the sponsor category first; document collection is the next step, rather than proof that an otherwise excluded application qualifies.

Build a file proving the relationship and support

The Enter Hungary family-reunification checklist connects documents to the claimed relationship: a spouse supplies a marriage certificate, a child a birth certificate, and an adopted child adoption evidence. It calls for official Hungarian translations where the original official documents were not written in Hungarian. A supported parent uses the child’s birth certificate; a relative claiming inability to support themselves on health grounds needs legal documentary evidence of that condition.

For maintenance, the checklist identifies a notarised undertaking by the receiving family member together with evidence of ability to support the applicant. It lists tax or employer income certificates and bank statements among the supporting evidence. Accommodation can be established through alternatives including a lease, ownership evidence or a notarised family accommodation statement. Comprehensive healthcare cover or evidence of savings to meet healthcare costs is also listed. These are separate evidential questions: proving a family relationship alone does not establish the household’s finances or housing.

Use the receiving consulate’s appointment and fee instructions

Hungary’s Istanbul consulate publishes an appointment-based route with submission at AS Visa followed by an interview at the consulate. Its family page says required documents must be presented as originals and copies. An incomplete application receives a missing-document list and is not forwarded to Hungary for evaluation until those documents are supplied. The practical preparation deadline is therefore the appointment, rather than the hoped-for travel date.

The Istanbul instructions quote a EUR110 residence-permit application fee, paid at AS Visa, and a separate EUR25 submission fee for the ordinary category. They require applicants to apply before travel and explain that a short-stay Schengen visa does not permit work or study beyond 90 days. These are Istanbul’s published receiving arrangements and charges, rather than a promise that another consulate uses the same contractor or local payment method. Someone applying elsewhere should obtain that mission’s appointment instructions and fee arrangements before making payment or travelling to a submission centre.

Resolve the translation difference before commissioning documents

The Baku embassy’s family-reunification page illustrates why local instructions also matter. It requests advance scans at least five working days before the appointment, with clear separate PDF files matching the hard copies and a combined size no greater than 8 MB. Its published process uses the consular email address displayed on that page; readers should follow the competent mission’s own submission channel rather than send documents to an unrelated post.

Baku also mentions student sponsors; this checklist does not override the national factsheet’s express exclusion of study permits. Baku’s relationship-document instructions accept a notarised English translation when the marriage or birth certificate is not in English. That differs from Enter Hungary’s requirement for an official Hungarian translation of official documents not written in Hungarian. The pages do not establish that Baku’s English version replaces the translation needed for the residence decision. Before ordering translations, ask the receiving mission whether English suffices for its intake only and whether a Hungarian translation will also be required by the deciding authority. This public-source comparison does not resolve an individual document’s acceptance.
