An agreed departure still needs formal approval
Foreign employees in Monaco planning to leave an indefinite contract by mutual agreement should arrange the formal termination process before fixing a move to another job. Law 1.583 introduced a written, voluntary termination agreement distinct from resignation or dismissal. It requires a preliminary meeting and approval by the labour inspectorate. Neither party can impose this route, and the agreed end date cannot precede the day after approval.
The law provides a seven-calendar-day withdrawal period after signature, which the parties can lengthen. Submission for approval follows that period. The inspectorate ordinarily has 15 working days after receipt, but requests for documents, interviews or amendments can suspend that clock. Silence has different consequences for protected employees. Do not calculate a new starting date simply by adding 15 days to signature, particularly when the inspector has requested further information.
Prepare the termination agreement with complete pay information
The implementing order identifies what the agreement must record. Employer details include the business identity, authorised signatory, contact information, address and social-security affiliation number. Employee information includes the job, start date, precise seniority at the proposed departure, and any protected-worker status. The agreement also records preliminary meetings and whether either side received assistance.
Pay information is substantial: gross monthly remuneration over the preceding twelve months, specified bonuses, and the higher average calculated over twelve or three months. The agreed gross termination payment must appear in figures and words, alongside the proposed departure date and withdrawal deadline. Use the official model and obtain the current annex rather than drafting a short informal release. For paper filing, the order requires two original agreements; the electronic route uses one copy. Changes in either party’s situation during verification must be reported promptly.
The next employer must follow its own recruitment procedure
The government employment-procedure guide describes a separate authorisation and work-permit request for recruitment. Once the Employment Service validates the acknowledgement stage, it sends a partly completed application based on the information supplied. The employer must complete employment details, workplace accident insurance and the relevant spouse, partner and dependent-child information. The guide requires the original document bearing both employer and employee handwritten signatures.
It publishes a five-euro registration charge and asks for the application promptly. Confirm the current collection method with the Employment Service; that amount is not a termination settlement or a charge for approval of the departure agreement. Following the required institutional approvals, the work permit is posted out and its detachable lower part must be handed to the worker. The guide lists +377 98 98 88 14 for reception, enabling the new employer to ask about an incomplete recruitment file.
Check registration and priority rules before assuming a start date
The Caisses Sociales explains that the employer first deposits a vacancy with the Employment Service. Priority candidates may be referred, and the employer returns the acknowledgement identifying the chosen candidate with identity evidence. The service assesses compatibility with employment-priority rules before issuing the combined hiring-authorisation and registration request. An agreement between a worker and a new business therefore does not complete the administrative process.
The employer is responsible for that request. A provisional social registration certificate can be issued while recruitment is being processed, but an adverse hiring opinion ends its effect. Social registration cannot begin retrospectively before the application was deposited. When employment ends, ordinary registration follows the theoretical end of activity, including notice and terminal paid leave, with specified continuation situations such as compensated illness or unemployment. Ask the Caisses about individual coverage rather than treating provisional registration as unrestricted permission to work.
Keep termination payments and immigration questions separate
The consolidated employment-contract law makes contract validity dependent on the relevant hiring formalities and the worker obtaining a work permit. Article 5-1 separately provides for a contract ending without notice or termination compensation if the permit is revoked during employment, or if a permit is refused following a new application. This is a different legal situation from a freely negotiated departure agreement.
The same consolidated law requires workers to return entrusted tools and unused materials in good condition. Keep the practical handover and the authorisation file organised separately. None of the reviewed employment resources settles a resident’s continued residence entitlement or a commuter’s permission in the neighbouring country. Before departure, obtain the approved termination record and ask the relevant residence authority what evidence of resources or new employment is required for the individual situation.
