Montenegro’s updated residence forms cover same-sex partners from 1 November

New residence application forms and amended relationship-evidence rules now apply in Montenegro. Partners should match their documents to the sponsor’s immigration status and confirm how foreign-issued partnership records will be assessed.

Use the forms that apply from 1 November

Montenegro began applying amended residence-form rules on 1 November 2026, including express evidence provisions for same-sex life partners. The Interior Ministry regulation was published on 8 October and entered into force on 16 October; its application date was separately set for 1 November. Those dates should not be treated as interchangeable.

The amendment replaces application forms 3 and 4. It also recognises, for the family-reunification evidence requirement, a competent authority's document establishing the specified partnership or other evidence justifying the request. Obtain the current form rather than reuse a previously saved version.

The regulation changes documentary requirements; it does not itself approve a partnership-based residence application or settle every question about a foreign-issued record.

Identify the sponsor’s status and the continuing eligibility conditions

The government-hosted consolidated Foreigners Law distinguishes a same-sex partner of a Montenegrin citizen from a partner of a foreign permanent resident or temporary resident. Article 44 includes those partnership categories. It also excludes family reunification with a foreigner holding residence and work permission for seasonal employment. A partner should therefore check the sponsor's actual permit basis, not only whether the sponsor currently lives in Montenegro.

Article 43 exempts the specified immediate family members and same-sex partners of Montenegrin citizens from the subsistence-evidence condition. That is a defined exception, not a waiver of accommodation, health-insurance, travel-document or other applicable requirements.

For renewals, Article 64 sets a filing window from sixty to thirty days before expiry. The new forms do not extend an existing permit. Someone whose renewal window overlaps the November change should obtain the applicable form promptly and preserve the submission evidence rather than wait until the permit expires.

Clarify which partnership record the authority needs

The government-hosted Life Partnership Law provides a separate reference for civil records. Article 32 says the partnership register includes partnerships of Montenegrin citizens concluded in Montenegro or abroad, and partnerships of foreigners concluded in Montenegro. Its scope should be checked before assuming that every foreign couple can obtain a local register extract for an overseas relationship.

The law also provides for the register to record the partners' identity, citizenship and residence information, the place and date of the partnership and later changes such as termination or correction of entries. Use that source to identify the civil record being requested and any mismatch in names or status.

The new regulation does not expressly resolve every overseas-document scenario. Ask the Interior Ministry which competent-authority document or other evidence it will accept for the actual relationship. Do not infer automatic recognition of every foreign marriage or partnership from the addition of a form field.

The government's temporary-residence guidance treats accommodation, insurance and evidence justifying the requested residence purpose as separate requirements. Supplying a relationship certificate should not be assumed to satisfy the entire residence dossier.

Separate the residence application from entry and processing arrangements

The government's temporary-residence service page directs personal applications to the Interior Ministry at the applicant's place of residence, with evidence supporting the residence purpose. It describes a forty-day decision period for a complete application. That period should not be treated as a guarantee that an incomplete or disputed file will be decided before a planned journey.

The Foreign Ministry's visa page separately explains visa applications and supporting documents. For a long-stay purpose, readers should check the travel document, photograph, evidence of the intended stay and the applicable consular payment. A new residence form is not a visa or a substitute for checking the entry rules applying to the traveller's nationality and documents.

The cited amendment does not state a new residence-fee amount or a dedicated fee exemption for using the replacement forms. Confirm the current assessment with the receiving office; do not infer that a procedural change makes the service free. Keep the current application, relationship evidence, sponsor's permit and payment instructions together so the next requested action is clear.
