Foreign employees in Saint Barthélemy should check work approval when a contract changes
The collectivity’s employee guidance links work permission to the employer and job. A residence card alone does not settle the authority to work locally.

Identify the permission attached to the job
Saint Barthélemy’s published employee guidance says a new contract or change of employer requires work authorization to be renewed. It also distinguishes residence permission from local work approval: wording on a residence card is not itself the Executive Council’s authorization to take a salaried job. This is a current explanation of the collectivity’s existing documents, not a newly announced employment scheme.
The guide was published in May 2020. Its old nationality list needs current verification. Ask the Foreign Labour Service whether a specific exemption applies. A worker’s permission from nearby Saint Martin should not be assumed to authorize a job in Saint Barthélemy. Employers and employees should establish the applicable route before the new contract starts.
Use the employee renewal form for an existing arrangement
The dedicated renewal form is for a foreign employee already holding residence documentation. It records the employer, worker, current residence document and expiry, job location, contract type, working hours, classification and gross salary. It separates salary from accommodation, meals and other benefits in kind. Both employer and employee sign. Check the proposed arrangement against those entries before the application is submitted.
The attached checklist asks for an employer’s renewal request and any necessary contract amendment. Employer evidence includes the current annual business contribution receipt and social-contribution compliance, with paid-leave contributions for construction businesses. The worker provides the passport, a clear colour copy of the valid residence card or its renewal receipt, and local accommodation evidence.
The housing section asks about the type and size of accommodation, shared occupancy and whether a room is shared. If housing forms part of the remuneration, make sure the application describes the actual arrangement rather than leaving it implicit in the employment contract.
Distinguish recruiting abroad from renewing local employment
A separate official introduction form covers an employee residing outside the territory. It asks for the person’s overseas address and contact details, and the employer’s registration and proposed employment information. The proposed start date, duties, qualification, collective agreement, pay and benefits must be specified. It also asks the reason for using foreign labour and details of employer-provided accommodation.
The approval section makes the territorial limitation explicit: authorization applies to the named employment and employer in Saint Barthélemy. A company should not treat approval for one role as a general staffing permission, and a worker should not rely on it for another employer. The form also distinguishes permanent and fixed-term contracts. Someone recruited overseas should ask the service for the introduction procedure, rather than submit a renewal form designed around an existing residence document. Keep the signed contract and the proposed accommodation details consistent across the file.
Check the entry document and current processing arrangements
France-Visas explains that French overseas territories are outside Schengen entry arrangements. Where a visa is required, the traveller needs permission valid for the overseas destination; a standard Schengen visa is not automatically sufficient. Exemptions depend on nationality and qualifying residence or long-stay documents. Entry permission and the collectivity’s work approval therefore need separate checks for an employee travelling from abroad. If the itinerary also includes mainland France and visas are required for both destinations, France-Visas says two distinct visas are needed. Check that additional leg before assuming the overseas visa covers the whole journey.
Use the official visa assistant to obtain the case-specific visa evidence and charges. The local work forms reviewed do not establish a universal application fee or a guaranteed current processing deadline, so confirm those points with the Foreign Labour Service before payment or travel. The older guide describes a two-month decision period for a complete file; it should not be treated as a promise for a particular 2026 case. Begin before the existing employment or residence permission ends and retain the actual written decision before assuming the changed job is authorized.
