Samoa employment applicants need both labour permission and residence approval

Current ministry guidance requires employer-linked employment permission, while immigration forms specify separate residence evidence and sponsorship responsibilities.

A job offer does not replace either permission

Non-citizens planning employment in Samoa should reconcile the labour and immigration requirements before travel or starting duties. The Ministry of Commerce, Industry and Labour's current employment-service guidance says employers must obtain a Foreign Employment Employee Permit before the employee starts work, and the worker must also hold a valid residence permit. This is a current procedural guide, not a newly announced recruitment scheme or an invitation to work as a visitor.

MCIL describes FEEPs as tied to the particular employer and role, non-transferable, and valid for up to three years subject to conditions. Its process includes an employer application package, labour-market assessment and an approved signed letter with a FEEP identifier. Use that service page to locate the current checklist and employment-agreement form. A vacancy, signed contract or pending application does not by itself establish that both permissions have been granted.

MCIL identifies the labour permission's statutory basis as Part IX of the Labour and Employment Relations Act 2013, as amended in 2023, and directs readers to its FEEP policy and 2025 brochure for detail. Those references help an employer distinguish the labour assessment from the separate immigration residence decision, even where documents are coordinated between ministries.

Immigration distinguishes short business visits from employment

The Ministry of the Prime Minister and Cabinet's permit-service page states that visitor permits do not permit work. Its business-visitor description concerns people normally employed and paid overseas making a short visit for activities such as negotiations, a conference or visiting their company's branch. Other business activity requires a temporary residence permit. Identify the actual duties and duration before choosing a category rather than calling a local assignment a business meeting.

For an employment-purpose temporary residence permit, the ministry says work is authorised for the employer named in the application. If that employment ends, the permit is subject to cancellation and the person must leave or apply for another permit to remain. There is no general job-transfer right established by that page. The immigration permit resource is therefore useful both before accepting a position and when an existing Samoan employment relationship changes.

Prepare the worker’s application and the employer’s undertaking together

The currently linked MPMC100 temporary-residence form is an older document and should be checked with Immigration for any replacement instructions. Its employment section asks for the employer sponsorship form and originals or certified copies of references, training or academic qualifications and other information needed for labour assessment. It also calls for recent passport-sized photographs and identifies medical and police reports according to age and intended length of stay. Check those thresholds before commissioning reports for each family member.

The linked MPMC101 sponsorship form is completed by the sponsoring employer. It asks for the position, main responsibilities, required skills, planned commencement and duration, as well as employer and worker details. Its undertaking addresses the costs of the worker's presence, medical treatment and departure, including accompanying dependants. Both parties should read those obligations before signing. The employer's sponsorship evidence must match the role described in the labour application; inconsistent duties or start dates should be resolved before submission.

Confirm the payable fees and approval timetable before booking travel

The older sponsorship information sheet states that processing its sponsorship form is free and quotes WST 600 for the principal temporary-residence applicant and WST 300 per dependant. The older residence form also distinguishes an offshore application from an application made in Samoa, quoting WST 1,200 for the principal onshore employment application, with a stated exception for further permits with the same employer. These are published form amounts, not confirmation that all present labour and immigration charges are covered.

Ask Immigration to confirm the current residence charge and MCIL to confirm any separate FEEP charge before payment. The residence form advises lodging 30 days before intended travel; the sponsorship sheet gives a four-week standard processing indication and says the process should be completed before arrival. Their age means neither should be treated as a guaranteed current service deadline. Obtain the approval documents before relying on a start date, check the named employer and validity, and separately verify any authority sought by a dependant to work. Family inclusion should not be assumed to grant employment rights.
