San Marino

San Marino pensioner residence requires both EUR 120,000 income and EUR 300,000 qualifying assets

Use the amended financial test, not the original 2020 figures

San Marino’s current pensioner-residence checklist must be read alongside the financial test amended by Law 64 of 28 April 2025. Article 2 requires demonstrable gross annual income of at least EUR 120,000 and movable assets of at least EUR 300,000 held within the Sammarinese banking system throughout the residence period. This is current explanatory reporting on an existing rule, not a new November announcement or an offer of automatic residence.

The conjunction matters: the amended provision specifies income and assets, not a choice between them. A person who meets only one figure should not treat the other as optional. The published legislation is the direct resource for checking that legal condition, while the Foreign Affairs Department’s application guide explains how the file is assembled. Older versions of the scheme’s original law should therefore not be used alone to assess a new application.

Check nationality scope and collect recent original evidence

The Foreign Affairs Department’s residence overview describes the pensioner route for applicants from EU countries, Switzerland and additional countries identified through a Congress of State regulation. It also addresses the applicant’s previous Sammarinese residence position. The overview does not establish that every pensioner worldwide qualifies. Applicants outside the named groups should ask the department which regulation covers their country before committing to housing or a transfer of assets.

The principal-applicant checklist, dated 27 May 2025, calls for original identity, birth, residence, family-status and criminal-record documents, a curriculum vitae and financial evidence. Documents generally must be no older than six months. Foreign documents outside Italian require the specified apostille and Italian translation. Additional material can be requested, so applicants should establish the deposit date before obtaining time-limited certificates.

Separate preliminary housing evidence from post-approval obligations

The principal checklist permits a preliminary housing arrangement conditional on residence approval and requires local bank-account evidence. After approval, it calls for the final housing document, the residence address and bank confirmation of the asset transfer. Applicants should coordinate those stages around the decision rather than assume preliminary evidence completes the file. The checklist gives no guaranteed decision date or universal annual closing date.

The amended law’s requirement to retain the qualifying assets throughout residence has a further practical consequence. The initial transfer is not the only financial event to plan: a proposed later withdrawal could affect the ongoing condition even if the applicant originally qualified. For illustration, a person planning to use the qualifying assets to fund a house purchase should distinguish the housing budget from the assets that must remain demonstrable in the Sammarinese banking system. The law does not make buying property a substitute for its stated movable-asset test.

A spouse has a separate checklist and the fee is not zero

The department publishes a separate secondary-applicant guide for a spouse. It requires identity, family and criminal-record documents, evidence of sufficient maintenance resources, the spouse’s rental contract and a local bank-account relationship, which may be jointly held. Both the resident pensioner and spouse complete the specified application declarations. This separate process means a principal applicant should not assume that their spouse is included solely because the principal’s financial evidence has been accepted.

The spouse checklist also requires the application declarations to address nationalities held, residence locations during the previous five years, criminal convictions, pending proceedings and compliance with tax obligations. Its own foreign-document and six-month validity instructions apply to that file. A couple preparing together should therefore compare both document lists and their issue dates, rather than assume that one partner’s certificates establish the other partner’s circumstances. The authority may request further evidence when the application is deposited.

The official checklists identify an EUR 1,000 file charge. The 2026 administrative-charge schedule describes the pensioner application as exempt from separate practice and stamp charges because those are absorbed by that EUR 1,000 payment; it does not make the entire application free. The government’s RIPOWeb payment guidance expressly includes atypical pensioner-residence duties among charges payable by credit card. Use the Registry Office’s payment instructions and retain the receipt for the application. Healthcare arrangements are another stage: after resident registration and obtaining an ISS code, the guide directs applicants to the Social Security Institute for information on coverage contributions and doctor allocation.
