Plan the labour stage before the immigration submission

Seychelles employers renewing a foreign employee’s Gainful Occupation Permit should begin with employment approval rather than treat Immigration as the only decision-maker. The Employment Department’s Procedure for Non-Seychellois Workers says renewal applications should be made no later than two months before the GOP expires. This guide concerns the existing process and does not announce a new November extension.

The Immigration and Civil Status GOP guidance describes the next stage: obtain the relevant Employment Ministry approval, then submit the permit application to Immigration. Its instruction to submit at least a week before work begins does not erase the earlier labour-renewal timetable. These are different stages of one employment arrangement, not alternative deadlines from which an employer may choose.

The immigration guidance also says prospective employees must not enter Seychelles for the purpose of taking employment before obtaining the GOP. A signed contract, recruitment approval or pending application should not be represented as permission to travel for work. Confirm the actual permit decision before arranging the employment start.

Prepare the employer’s recruitment and accommodation file

The Employment Department procedure lists vacancy-advertising evidence, respondents, the company establishment list, business licensing and incorporation material, and the prospective worker’s CV where known. It also identifies accommodation approval, localisation or training plans and other supporting evidence where applicable. For renewal, include the previous GOP. Use the department’s complete checklist to determine which additions apply to the particular employer.

This is a company evidence file as well as an employee file. A recruitment officer should arrange advertising and local-candidate records while another responsible person checks the accommodation and corporate documents. That division avoids discovering at the permit deadline that the employee supplied a passport but the employer cannot support its recruitment decision.

The Immigration GOP Section FAQ supplies the separate immigration checklist. It identifies employment approval, establishment and entitlement records, a valid readable passport, photographs, CV and competence evidence, qualification evaluation and sector-specific approvals. It says occupational-health medical fitness evidence is mandatory for employment exceeding one month. This immigration evidence should be reconciled with the labour submission rather than assumed identical.

Treat a new title or duty as a permission question

Immigration says the relevant approval and application procedure also applies to extensions and changes of post title or duties. Its GOP FAQ identifies a variation form and employment approval specifying the change for a post-title change. A promotion letter therefore should prompt an immigration review before the employer assigns duties outside the approved position.

The Employment Department’s Labour Migration FAQ separately says the foreign worker should work only in the approved post and for the approved employer. Where the proposed move involves another employer, ask for instructions on the appropriate fresh approval or change procedure. Do not assume that a variation of title automatically authorises a transfer between companies.

For a refusal of employment-post approval, that labour FAQ gives an appeal period of seven working days from the decision. Record the decision date and seek the appeal instructions promptly. This is not the same as a GOP-expiry deadline, and an appeal should not be treated as an automatic extension of residence or authority to continue working.

Confirm the fee and complete the post-arrival employer duties

The accessible official pages contain a material fee discrepancy. Immigration’s GOP overview lists SCR1,000 processing and SCR500 per month or part-month, while the Foreign Affairs FAQ lists SCR1,000 and SCR700 per month. Immigration also points to a newer fee attachment that could not be retrieved reliably during this check. Neither monthly amount should therefore be presented as a conclusively verified current invoice.

Ask Immigration for the applicable current schedule and a written calculation for the requested duration before payment. Keep application, permit and any employment-contract attestation charges separate. For self-employed applicants, Immigration describes a different preliminary business-proposal assessment through the Seychelles Investment Board; the ordinary employee sequence should not be transplanted to that route without checking.

The Labour Migration FAQ also describes submission of the fixed-term employment contract for attestation after one month of employment, with the GOP copy, one original and three contract copies and an SCR750-per-person attestation fee. Confirm the current submission arrangement with Employment. The practical sequence is labour approval, immigration permission, authorised work and the employer’s remaining contract obligations. None is replaced by visitor entry eligibility, and the sources do not establish a blanket nationality exemption from GOP requirements.
