Students in Sint Maarten need new permission before moving into employment
Completing a course does not convert a student residence permit into a work permit. Official guidance sets out a change-of-purpose application and separate labour evidence.

Check what the student permission actually allows
Sint Maarten’s Immigration and Border Protection Service says students may enter the labour market after their studies only by obtaining a labour permit and a new residence permit for employment. Its student guidance prohibits ordinary work alongside study, with an exception for a compulsory internship. A job offer or completed degree should therefore not be treated as authority to begin work on the existing student permission. This guide describes the existing procedure.
The immigration FAQ limits student permits to one year at a time and ties the total period to the programme’s official duration plus up to one additional year to complete it. Graduates should arrange their next category before permission ends.
Assemble the change from study to work file
The government’s dedicated Change from Study to Work service lists a colour passport identity-page copy, police record no older than six months, detailed Census registration no older than six months and a copy of the valid temporary residence permit. It also asks for the employment contract and employment permit, while accepting proof that the labour application was accepted to begin processing.
That last provision concerns starting the residence application; it is not a statement that work may start while the labour decision is outstanding. Confirm both permissions before arranging the first working day. Where the employer is a sole proprietorship or staff will live on the premises, the service adds employer and tax documents. The change-of-purpose service requires clear, legible PDF documents. Immigration may request originals or further evidence, so retain originals.
The service warns that the selected purpose must be correct because processing fees are non-refundable.
Do not confuse admission documents with employment evidence
The separate first-time student service illustrates why the files are different. It asks for all passport pages, an original police record translated into Dutch or English, a legalized or apostilled birth certificate with translation and a school registration letter. It also calls for financial evidence in the form of a bank letter. The birth certificate must not be older than three years. Check the age and translation of that document before reusing a file prepared for a different application. A new employment contract does not replace every underlying identity or civil record.
First-time student applicants are told to await the decision abroad. The same service warns that a permit more than three months past expiry becomes a first-time request requiring a Minister of Justice exemption letter. That threshold should not be interpreted as permission to remain or work without valid status for three months. Ask Immigration about any lapse before choosing a route, particularly if a graduate has already left the island or the previous permission has expired.
Submit the right application and verify payment
The government’s temporary-residence extension service distinguishes Model2, for changing the purpose of residence, from Model3, for extending a temporary permit. It allows a representative to apply and collect using a power of attorney. Applicants using assistance should still verify that the filed category corresponds to their intended employment and that the supporting labour evidence is included. The service identifies applicants under eighteen as children and those eighteen and older as adults. Confirm which category applies when a dependant finishes school and begins an employment application, especially if a parent previously managed the residence file.
That service publishes a general estimate of six to eight weeks for permit requests, rather than a guaranteed date for an individual graduate. Its fee field does not state a fixed amount. The immigration FAQ says the system generates a case-specific invoice, which is paid using its payment reference; applicants must return to upload payment evidence and submit. Keep the receipt and confirmation. Paying without completing submission, or submitting without the required evidence, should not be assumed to secure a decision before the current permission expires.
