Workers changing employers in Slovakia should wait for the required approval

Check that the existing permission still covers the move

Non-EU employees in Slovakia who hold valid temporary residence for employment and have found a new job should arrange the employer-change procedure before starting it. IOM's Migration Information Centre says the new employer handles most of the process and the worker waits for the Labour Office's consenting confirmation. This guide concerns that route, rather than a first residence application, an EU Blue Card or an unrestricted right to work.

Ask the new employer to show that the confirmation has actually been obtained. A job offer or signed contract is not the confirmation described by IOM. Keep the proposed starting date conditional on the applicable approval instead of assuming that holding an unexpired residence card makes every new job permissible.

Allow time for the vacancy procedure

IOM's vacancy guidance says the employer generally reports the position to the Labour Office responsible for the workplace at least twenty working days before requesting a vacancy confirmation. Where the office must assess the labour market, a suitable registered jobseeker receives priority. The employer should establish which procedure applies before promising an immediate start.

Some categories avoid that labour market assessment, including specified scientific or educational work and qualifying shortage occupations. They may still require vacancy reporting no later than the confirmation request. An exemption from assessment is therefore different from an exemption from reporting. The linked vacancy guide explains these distinctions; do not infer an exemption merely because recruitment has been difficult.

Give the employer the documents for its electronic request

The Labour Ministry's application service expressly covers a change of employer or an additional employer for a third-country national. The request goes electronically to the competent Labour Office through the public administration portal, and the ministry states that this application is free. The employer needs an electronic identity card and must electronically sign the submission; an unsigned form cannot be sent.

Prepare a copy of the employment contract or written employment promise and both sides of the existing residence document. Regulated professions also require the specified education or recognition evidence. The ministry describes official translation rules for foreign-language supporting documents, including permitted Czech-language alternatives. Agency assignments and certain shortage-occupation cases have additional attachments. Ask the employer to identify the relevant category on its checklist rather than assuming the ordinary contract is the entire submission. The free confirmation request does not establish that every possible residence-document service is free.

Report any unemployment and watch residence expiry

IOM's employment residence guide requires holders covered by its stated employment categories to notify the Foreign Police of the beginning and end of unemployment within seven working days. Arrange that reporting separately from the employer's Labour Office request. The same guide ties work to the employer, position and workplace in the relevant confirmation or other qualifying document.

A change of employer must also be distinguished from renewal when residence itself is expiring. IOM says renewal must be submitted no later than the last day of residence validity. It lists EUR140 for a paper renewal or EUR90 electronically, plus separate card charges. Those are renewal fees, not a universal employer-change price. Its unemployment protection provisions depend on the residence basis and circumstances; they should not be read as a blanket extension of an expiring permit. Ask the Foreign Police which dates govern the individual file.

Coordinate the old job ending and insurance registration

IOM's termination guidance distinguishes resigning with notice from a written agreement fixing a specific termination date. Notice generally starts on the first day of the following calendar month. A mutual termination agreement can set another date, but it requires both parties' agreement. Check that date before telling the new employer when the old employment ends.

The Social Insurance Agency says an employee ordinarily does not report an employer change to it. The former employer deregisters the employee within eight days of termination; the new employer must register the person before work starts. This allocation of insurance duties does not replace immigration notifications. Someone receiving unemployment benefit should report starting work within eight days, because entitlement ends when the new job begins. Use the agency's linked instructions for that benefit-related report.
