Check the pending case against the signed directive

South Africa's Immigration Directive 7 of 2026 provides a temporary concession until 30 June 2027 for specified waiver, long-term visa and appeal cases pending at its signature on 30 March 2026. It took effect on 1 April. This current follow-up explains the limits for applicants considering travel; the June 2027 date is not a new visa expiry automatically available to everyone awaiting an immigration decision.

The directive requires lawful admission and an application through VFS Global with a verifiable tracking receipt. Permanent-residence applications are outside it. It also excludes appeals against visitor-visa renewal refusals under section 11(1)(a) pending longer than three months. Existing visa conditions continue to limit activities, and the concession ends immediately when the outcome is received. Use the signed directive to establish coverage before relying on its date, retaining the original permission, receipt and any decision together. Someone outside its scope needs an individual status assessment rather than assuming the backlog provides protection.

Backlog targets are not individual approval promises

Parliament's committee statement of 27 August 2026 welcomed the concession but called for predictable processing rather than repeated emergency backlog measures. It reported 21,847 pending appeals as at 28 July, with 13,148 overdue, and a departmental target to clear overdue applications by 31 March 2027. Those are dated workload figures and an administrative target, not confirmation that any named application will succeed or finish on a particular day.

The distinction helps applicants interpret a long silence without drawing an unsupported conclusion. A case can remain pending, be requested for further evidence or receive an outcome that changes the next action. Keep monitoring the official application channel and respond to actual notices. Parliament's account supplies context about the delay, while Home Affairs' signed directive establishes the concession's terms. Neither should be substituted for the decision letter that determines what an individual must do after adjudication.

Departure protection does not remove the re-entry visa check

The directive allows covered applicants to depart and re-enter within its period without an undesirability declaration on the specified overstay ground, but non-visa-exempt nationals still need a port-of-entry visa before returning. Appeal applicants must carry the refusal letter and appeal receipt or confirmation. That travel provision is not permission to undertake work outside the existing visa conditions or a promise of admission regardless of other requirements.

The government's public visa service page distinguishes visa-required visitors from exempt nationalities and says visas are not issued at the border. Use its official requirements and exemption links to identify the relevant nationality and purpose before arranging departure. A pending-case receipt explains the application history; it does not answer every entry-visa question. Ask the competent South African mission about the correct application for the actual return circumstances rather than presenting the receipt to an airline as though it were a newly issued visa.

Use the responsible mission’s checklist for the return application

The South African consulate in New York publishes a June 2026 port-of-entry checklist that illustrates the separate evidence needed for a visa application in its jurisdiction. It lists DHA-84, a machine-readable passport with two unused visa-label pages and at least 30 days' validity beyond intended departure, photographs, purpose and itinerary evidence, accommodation and three months of financial statements. Applicants must use the mission responsible for their residence and confirm which checklist fits their case.

The New York document quotes a US$55 non-refundable fee where applicable and a ten-business-day processing indication; these are not universal charges or guaranteed timings for other missions. It also requires qualifying US residence evidence and says B1/B2 visitors must apply in their residence country. Before committing to travel, reconcile the pending case, current status, return-visa requirements and mission appointment. The directive's outer date does not remove those practical steps, and receipt of an outcome can bring the concession to an end earlier. Seek case-specific clarification where any of those documents or dates conflict.

The same mission checklist identifies additional evidence for accompanying children, including birth and parental-consent documents where relevant. Families should check those requirements for the proposed travelling group before a departure, because the principal applicant's concession receipt does not establish consent or custody for a child.
