South Korea’s E-9 workers face two deadlines when changing jobs

A current guide distinguishes applying to change workplace from obtaining immigration permission, with limits and exceptions that depend on the worker’s circumstances.

Check the rules for the E-9 category before resigning

South Korea’s Employment Permit System allows E-9 workers to change workplace only within its rules, rather than offering unrestricted movement between employers. The Ministry of Employment and Labor describes a limit of three changes during the first three years and two during the subsequent re-employment period of one year and ten months, where a legally recognised reason exists. Employer-attributable changes, such as closure or suspension of business, are excluded from that count.

This current guide, checked on 2 November, concerns non-professional E-9 workers already employed through the system. It is not a newly announced visa concession or a general job-search route for visitors. The ministry distinguishes this system from H-2 working visits for eligible ethnic Koreans, whose mobility rules differ. It also says E-9 workers cannot simply move between industries. Use the ministry’s English EPS explanation to identify the correct category before assuming that another foreign worker’s experience applies to you.

Record the contract-end date and the application date separately

The labour ministry’s workplace-change FAQ says an E-9 worker with a qualifying reason must submit the workplace-change application within one month after the employment contract ends. It identifies the EPS website or the employment centre responsible for the workplace as submission routes. A worker should therefore establish the actual contract-end date and obtain proof of submission rather than calculate the period from an informal promise of another job.

The FAQ then identifies a separate three-month period, beginning when the workplace-change application is made, within which the worker must obtain immigration permission to change workplace. It says workers who miss the relevant one-month application or three-month permission requirement must leave. Finding a vacancy, arranging an interview or signing an offer is not the same event as receiving that permission. Use the FAQ to identify the two clocks, then ask the employment centre how any recognised exception affects the dates in the individual case. Do not assume the longer period replaces the earlier filing deadline.

Prepare evidence and check regional placement restrictions

The government’s Work24 workplace-change guidance lists the application, confirmation of the reason for changing workplace, passport, foreign-resident registration card and other evidence supporting the qualifying reason. Grounds include an employer ending or not renewing the contract, specified employer-related problems, or injury preventing continued work at the existing workplace. The employment centre must assess the applicable ground; a worker should not classify every resignation as an employer-attributable exception.

Work24 also describes placement within five regions based on the initial authorised workplace. It allows movement from the capital region to another region at the worker’s request, and specified movement between non-capital regions after a month without a placement. Confirm the permitted destination before accepting a distant offer. It describes timing exceptions where an occupational accident, illness, pregnancy or childbirth prevents applying or obtaining permission. Bring supporting evidence and ask the centre to establish the adjusted deadline. These exceptions are not an automatic extension for every unemployed worker. The same page explains the new employer’s separate recruitment and employment-permit steps.

Complete the immigration application rather than stop at job matching

The Ministry of Justice’s Visa Navigator lists E-9 workplace changes among the applications available through HiKorea. Its application guidance distinguishes electronic filing from visiting an immigration office, and says visits for workplace-change permission normally require an online appointment. Using an agent does not guarantee that a personal appearance will be unnecessary: an officer may still require identity checks, fingerprints or clarification of facts.

Use the Navigator to find the immigration application route, and check the current HiKorea status-specific checklist or call immigration’s 1345 contact centre for the documents and fee that apply. The resources reviewed do not establish a current fixed charge for this exact transaction, so no amount is presented here as confirmed. The worker should keep the employment-centre submission, the new employment paperwork and immigration’s decision together. A job match or submission receipt should not be read as the final workplace permission. Before starting at the new workplace, confirm that the required immigration step has been completed and that the underlying period of stay remains valid.
