Spain non-lucrative residence renewals require deadline and filing-channel checks

Current renewal rules retain a two-month advance window, while a published court judgment makes older blanket online-filing instructions unsafe to assume.

Renewal applicants should separate the deadline from the filing channel

Spain's non-lucrative residence holders approaching expiry should check both their renewal window and the current instructions of the competent immigration office. This current guide concerns an existing residence permission, not a newly announced visa programme. Article 64 of the consolidated immigration regulation provides a two-month period before expiry in which to apply for renewal. A timely application extends the previous authorisation until the procedure is resolved.

The regulation also permits filing within three months after expiry, with extension pending a decision, but expressly allows sanction proceedings for lateness. That later period should therefore not be treated as an equally safe planning window. Record the permit expiry first, then establish the earliest application date and prepare the evidence before that window opens. These are individual permit deadlines, not a single national November closing date.

A September-published judgment qualifies older digital instructions

The Supreme Court's judgment of 29 July 2026, published in the official gazette on 22 September, reiterated the annulment of article 197.2 in its entirety. The published ruling preserves the possibility of properly justified and proportionate electronic obligations for particular procedures. It does not establish that every applicant can disregard all electronic requirements or submit to any office.

This matters because the ministry's renewal information sheet, marked as updated in May 2025, directs applicants to the Mercurio electronic service. Use that sheet to locate the service, but check the competent office's current filing arrangements against the later judgment if electronic access is a problem. Seek confirmation of an available lawful submission method before expiry and retain proof of submission. The court decision concerns procedure; it does not waive the substantive residence conditions or extend the application window.

The renewal evidence covers the proposed residence period

The ministry's renewal checklist specifies the signed EX-01 form, a complete valid passport copy and evidence of sufficient resources and health insurance. Where compulsory-school-age children are involved, it also identifies schooling evidence. Foreign public documents can require legalisation or an apostille unless an exemption applies, together with the appropriate sworn translation. Use the checklist to identify documents requiring preparation abroad, rather than discovering that requirement immediately before filing.

The consolidated regulation requires actual residence in Spain for more than 183 days during the calendar year, continued insurance and resources without needing employment or professional activity. It links the financial test to article 62: 400% of monthly IPREM for the applicant and an additional 100% for each dependent family member, assessed over the authorisation sought. Renewal normally lasts two years unless long-term residence is appropriate. A bank balance adequate for an earlier one-year application should not automatically be assumed sufficient for the next period.

Keep initial visas, renewal fees and the identity card distinct

This route is for residence without gainful work. Spain's London consular page explains the initial non-working visa process and insurance requirements; it is relevant to applicants in that consular jurisdiction, rather than a substitute for renewal inside Spain. Applicants of different nationalities or residence locations should use their own competent consulate for an initial application. The route does not become permission for remote employment simply because the employer is overseas.

For an initial London application, the consular checklist also calls for adult applicants' criminal-record certificates covering countries of residence during the previous five years and a medical certificate addressing the International Health Regulations standard. These are initial-visa requirements: do not automatically substitute that consular checklist for the domestic renewal checklist. The distinction helps applicants commission the correct evidence and avoid paying for unnecessary replacement certificates.

For renewal, the ministry identifies fee form 790, code 052, heading 2.2.1, payable within ten working days after admission for processing. Obtain the applicable amount from the official payment form; initial visa and identity-card charges are separate transactions. Following renewal approval, the regulation requires a personal identity-card application within one month of notification. The National Police foreigner-document resource helps identify the card appointment and supporting documents. Keep the approval, passport and payment evidence together, and distinguish the residence decision from the subsequent physical-card appointment.
