Arrange immigration permission before travelling

Foreign entrepreneurs planning to operate a business in Tonga need to arrange business immigration permission separately from registering their investment. This current-rule guide concerns establishing a business, rather than attending an ordinary meeting. The Beijing embassy says a visitor visa prohibits business activities and directs business visa applicants to apply before entry. A registered company alone therefore does not settle the founder's immigration position.

The embassy also describes advance written notification for prospective investors entering as visitors, alongside an adjustment charge. Ask Immigration which entry permission applies before travelling; this wording does not authorise trading. Its one-month estimate allows for inspections and is not guaranteed. Beijing submission instructions apply to that embassy.

Prepare the visa checklist but check its age

The government-hosted business visa checklist requires a completed application, signed declaration, two recent photographs, a passport covering the proposed permission and two character references with contact details. It specifies a medical report issued within six months and national police clearance issued within three months for applicants over 16, normally from their country of ordinary residence. Immigration reserves the ability to request records relating to residence in the previous five years.

However, the document itself is marked updated 23 November 2006, despite its more recent upload path. Its TOP230 application charge and TOP1,150 adjustment or overstay charge cannot be assumed to be today's payable total. Ask Immigration for the current business category fee and approved medical form before paying or arranging examinations. The checklist also requires ministry support, English translations and copies when applicants want originals returned. Renewal tax-history evidence is a separate requirement for existing permit holders.

Register the investment through the right account

The Business Registries guidance explains that foreign investment certification covers foreign companies, individual non-citizen investors and even a locally incorporated company with one foreign-owned share. A person applying as an individual supplies passport identification; overseas companies may already have supplied much of their information through company registration. The application also identifies any local representative, intended activities, operating locations, expected investment and employment.

Use the linked registry instructions to create the business entity account and locate Foreign Certification. A draft can be saved before checkout. Submission sends the application for the Registrar's review; a request for further information leaves it pending until that information is provided. The certificate is emailed after approval. A saved draft or pending registry submission is consequently an unfinished investment application, not an immigration decision or authority to begin the proposed operation.

Check the activity and investment conditions first

The linked Foreign Investment Regulations 2021 contain reserved and restricted activity lists. The reserved list includes guesthouses and youth hostels, with separate exceptions attached to some transport and manufacturing activities. Investors should identify the precise listed activity instead of assuming that every tourism business has identical conditions. Restricted activities can require Tongan equity and a specified cash contribution; those conditions are separate from visa paperwork.

Schedule 3 lists TOP500 for an application to issue an investment certificate, payable on filing. This is the investment registration charge, not the business visa fee. The regulations define a twelve-month implementation period from certificate issue. For a restricted activity, an application to extend that period must be made at least thirty days before it ends. That is a business implementation deadline; it does not extend an individual's immigration permission.

Obtain the business licence as a separate approval

The embassy's business licence instructions require foreign investors to have their investment certificate before a licence is issued. Form 1 records the owners, ownership structure, business activities and actual operating addresses; a post-office box does not replace the principal business location. Regulated activities may need additional approvals before commencement. An entrepreneur should therefore prepare consistent activity and ownership information across investment, licence and immigration applications, while checking the current receiving office and charges with each authority.
