The government response still requires detailed implementation rules

Health and education workers planning UK settlement should check their occupation and existing permission before assuming the government’s new framework changes their application today. The Home Office published its earned-settlement consultation response on 2 November. Its outcome page describes a general move from a five-year to a ten-year starting point, with earlier qualification for specified contributions and protections for certain existing groups.

The same page says the framework must next be translated into detailed rules and operational arrangements. Further technical guidance and an impact assessment are to precede implementation. An announced five-year protection is therefore distinct from a present individual eligibility decision.

Match the public-service protection to the named occupation

The response PDF provides a five-year pathway for eligible public-service health and education occupations linked to national pay scales, subject to the other settlement requirements. Annex C names professions including registered nurses, doctors, physiotherapists, teaching occupations and social workers. A job in a hospital or school is not by itself enough to establish membership of a listed occupation.

The document separately describes a one-off arrangement for existing workers in specified national-pay-scale occupations below degree skill level, such as nursing auxiliaries and teaching assistants, who came before publication of the May 2025 immigration white paper. That is different from a permanent five-year pathway for every future recruit to those jobs. Keep the occupation code, sponsorship history and relevant dates available for comparison with the eventual detailed rules. Do not assume that everyone employed by the same organisation receives identical transitional treatment.

Check today’s qualifying period and current permission before filing

The existing settlement overview still describes five years of qualifying UK residence and work, the applicable salary and a continuing need for the sponsored job. It requires an employer document confirming that continuing employment. The earliest application is normally 28 days before completing the qualifying five years; filing earlier may result in refusal.

The current page says not to wait until permission expires. If the visa ends before settlement eligibility is reached, renewal is needed first. It lists £3,226 for each applicant and no separate biometric fee. These are current published application arrangements, not a guaranteed future charge under the new framework. Do not pay solely because a policy announcement appears favourable: first check the actual route, qualifying date and current permission.

Review absences and time under earlier visa categories

The separate Time in the UK page says qualifying applicants must generally have spent no more than 180 days abroad in any twelve-month period. It points to the continuous-residence guidance for the detailed calculation. Assemble travel dates before concluding that five calendar years since arrival necessarily provide five qualifying years.

The same page excludes time spent as a dependant partner or child from this principal-worker calculation. It permits specified combinations of work and talent routes, including Skilled Worker, Global Talent, Scale-up and Innovator Founder, but not every UK visa. For illustration, a worker with earlier dependant permission should check the qualifying combination rather than count the entire period since the first UK arrival. This current calculation and any future transitional treatment are separate questions.

Use the salary category that matches the actual sponsored job

The current salary guidance normally requires the higher of £41,700 and the occupation’s standard going rate. It has different provisions for eligible healthcare and education roles paid according to national pay scales: the higher of £25,000 and the relevant pay-scale going rate. Ask the employer to identify the role and pay band instead of applying a minimum from an unrelated occupation.

Other Health and Care Worker occupation codes have their own salary provisions, while earlier sponsorship and Immigration Salary List cases can also differ. Use the relevant subsection and linked rate table for the actual case. The page says the national-pay-scale going rates apply in both public and private sectors. That present salary rule should not be confused with proof of qualification for the future public-service settlement protection.

Prepare the online application evidence when the current route permits it

The How to Apply page directs eligible applicants to the online settlement form. It identifies evidence of passing the Life in the UK Test, meeting salary requirements and continuing employer need among the documents that may be requested. The form can be saved and completed later, and the fee is paid as part of the application.

The linked assisted-digital service can help eligible UK-based applicants who lack internet access or confidence using a device. It does not provide immigration advice. Keep the employer evidence, residence history and relevant test information ready, then follow the document requests generated for the application. No individual protection, commencement date for the wider framework or settlement outcome has been confirmed by this public-source comparison.
