US passport holders need the correct form after a legal name change

The no-fee route depends on both the passport issue date and the legal name-change date.

Check the passport issue date and the legal change date

Adult US passport holders with a documented legal name change should check both dates before choosing a form. State Department guidance provides a no-fee mail route using DS-5504 where less than one year has passed since both passport issuance and the legal name change. Send the most recent passport, one passport photograph and the original or certified legal-change document, such as a marriage certificate, divorce decree or court order.

If more than one year has passed since either event, assess ordinary renewal eligibility or apply in person. A recent marriage does not by itself make a much older passport eligible for the no-fee route. This guide concerns documented legal changes; people using another name without a legal-change document should read the separate evidence instructions. It is an existing procedure, not a new November fee waiver.

Use the mail-renewal checklist when the no-fee route does not fit

The Renew by Mail resource requires the most recent passport to be available for submission, never reported lost or stolen, issued within the preceding fifteen years and issued at age sixteen or older. It must have been valid for ten years and be undamaged apart from ordinary wear. The name must match the current name or be linked by the appropriate legal document. A changed surname does not remove these other renewal requirements.

Eligible applicants use DS-82, print the form on single-sided paper, and sign and date it before mailing. Include the most recent passport, a certified copy of the legal name-change document and one photograph, following the form’s attachment instructions. The department returns the old passport and name-change document separately, so receiving the new book does not necessarily mean every supporting document will arrive in the same envelope. Mail-renewal applicants should not be charged the US$35 acceptance-facility fee for a postal employee to review the packet. Applicants outside the United States should use the relevant overseas renewal instructions rather than assuming the domestic mailing procedure applies.

Apply in person if renewal eligibility is missing

The adult-application guidance directs people who do not qualify for renewal to an acceptance facility using DS-11. This includes applicants whose earlier passport was issued more than fifteen years ago or before age sixteen, or was lost, stolen or damaged. It is a different signing procedure from DS-82: print the form single-sided and wait to sign until the passport acceptance agent instructs you.

Prepare physical evidence of US citizenship, an accepted photographic identity document, the required photocopies and one passport photograph. The guidance identifies a full-validity undamaged US passport, a qualifying US birth certificate or a naturalisation or citizenship certificate among the citizenship-evidence options. Digital images of citizenship evidence are not accepted instead of the physical record. An out-of-state identity document can require a second photo ID. The acceptance agent reviews and attaches the photograph, so do not staple it yourself for this route. Bring the documents that connect the old and new identities and follow the name-change guidance for the particular evidence situation. A form completed online is not, by itself, an in-person application.

Separate the application charge from handling and optional services

The State Department fee page lists US$130 for an adult passport-book renewal, US$30 for a passport card and US$160 for both. For an adult DS-11 application, the same application charges are accompanied by a separate US$35 acceptance fee. The two payments have different recipients: the application payment goes to the US Department of State and the acceptance payment goes to the facility. The published name-change fee depends on the route, so use the official form guide and calculator if the category is unclear.

Expedited processing adds US$60; it does not turn an ineligible DS-5504 case into a free renewal. For mail applications, the fee page specifies a cheque or money order payable to the US Department of State. Ask the acceptance facility which methods it accepts for its own charge. Application and execution fees are generally non-refundable even if no passport is issued. Keep optional faster processing separate from return delivery and consider postal time before booking travel. No individual completion date or eligibility determination was established through these public resources.
